High Court Acquits 3 Mentally Challenged of Murder

High Court Judge Helena Charehwa has acquitted three mentally challenged individuals, including Moreblessing Magomana, Last Makasi, and Muzondiwa Vanganani, of murder charges due to insanity, as per Section 29 (2) (a) of the Mental Health Act.

Magomana, 34, from Chiredzi, was accused of killing a six-month-old infant, Tanatswa Masikiti, after calling him a “goblin.” She smashed the infant’s head on the ground and slit his throat. Tatenda Nyoka represented all three accused on a pro deo basis.

“The accused’s mental state was a significant factor in these cases,” said Justice Charehwa. “We must consider the complexities of mental health and its impact on individual actions.”

Last Makasi, 29, from Masvingo, was accused of striking his four-year-old niece, Rosemary Mudadigwa, with a mattock, leading to her death. He also faced attempted murder charges for attacking his five-year-old nephew.

Muzondiwa Vanganani, 68, from Mwenezi, was accused of killing his brother, Kefas Ngwenya, 49, with a log.

These cases highlight the need for greater understanding and support for individuals struggling with mental health issues. As Justice Charehwa emphasized, “It’s crucial to address the root causes of these tragedies and ensure the accused receive appropriate treatment and care.”
