HARARE – The highly anticipated rape trial of Prophetic Healing and Deliverance (PHD) Ministries leader Walter Magaya failed to commence today following a heated procedural standoff between his legal team and prosecutors at the Harare Magistrates Court.
Magaya made a brief appearance before the magistrate,但他的 lawyers insisted the matter should proceed in an open court with witnesses testifying publicly. However, prosecutors from the National Prosecuting Authority of Zimbabwe (NPAZ) argued that key witnesses must be allowed to testify via video link, citing concerns for their safety and protection.
“The State submits that the witnesses require protection, and virtual testimony is the most appropriate mechanism to ensure their security while allowing them to give evidence without intimidation,” a prosecutor submitted in court.
Presiding Magistrate Mrs. Feresi Chakanyuka upheld the prosecution’s position, ruling that witnesses will be permitted to testify via video link when the trial eventually commences. The magistrate emphasized that the court has a duty to balance the rights of the accused with the protection of vulnerable witnesses.
In response, Magaya’s legal team signalled their intention to challenge the ruling, indicating they will file an application to refer the matter to the Constitutional Court of Zimbabwe.
“We are not satisfied with the ruling. Our client is entitled to a fair trial, which includes facing his accusers in an open court. We will be approaching the Constitutional Court to challenge this decision,” said Magaya’s lawyer, Mr. Lovemore Madhuku.
Legal experts suggest the move is likely to delay proceedings further, potentially pushing the trial back by several months while the constitutional question is determined.
Magaya, who remains on bail, left the courthouse without speaking to journalists gathered outside. His followers, some of whom had gathered in solidarity, dispersed quietly after the brief proceedings.
The case has drawn significant public attention, with women’s rights groups closely monitoring developments.
The PHD Ministries leader faces one count of rape, allegations he has consistently denied.
The matter is now expected to return to court once the Constitutional Court application has been filed and processed.
