HARARE – The Minister of Justice, Legal and Parliamentary Affairs, Hon. Ziyambi Ziyambi, has issued a clarification stating that all statutory fees, levies, and charges remain legally binding until the laws governing them are formally amended or repealed by Parliament.
This statement comes in response to numerous public queries following recent government pronouncements about plans to reduce various costs across sectors such as transport and agriculture.
In an official communication, Minister Ziyambi emphasized that while the Government has adopted a policy position to lower charges, this policy does not take immediate legal effect.
“All fees, levies and charges prescribed in existing laws in the form of primary and subsidiary legislation shall continue in force and effect until such a time when the statutory provisions providing for the same have been amended or repealed in accordance with set procedures,” the Minister stated.
He outlined the process underway to translate the new policy into law, noting,
“The ministry, together with the Office of the Attorney-General, is working with all relevant ministries to ensure that the policy position adopted by Government to reduce the various fees, levies and charges is translated into legally binding legal instruments.”
Linking the reforms to the national development agenda, Minister Ziyambi referenced the Constitution, saying,
“We have a positive obligation, as aptly enunciated in Section 114 of the Constitution of Zimbabwe, to ensure that statutes are drafted to eliminate any gaps in the law.”
He further added that the ultimate goal is to “draft and enact laws that enhance the investment climate and facilitate the ease of doing business in Zimbabwe,” aligning the statutory framework with the Government’s Vision 2030 objectives.
The public is therefore advised that all existing fees remain legally enforceable until such time as the new legislative amendments are formally enacted.
