In a significant decision, the High Court of Zimbabwe has ordered writer and lawyer Petina Gappah to pay $18,000 in damages to prominent lawyer and politician Fadzayi Mahere, following a protracted defamation lawsuit.
“The defamatory statements were vile and persistent, justifying the substantial damages awarded to Mahere,” said Justice Mafusire in the written judgment.
Mahere claimed that Gappah’s statements had significantly harmed her reputation, leading to the lawsuit in October 2018. Despite initially contesting the claims, Gappah admitted liability shortly before the trial.
“The legal battle was long, arduous, and acrimonious,” Justice Mafusire noted, highlighting the intense legal strategies employed by both accomplished lawyers.
In addition to the damages, Gappah must pay 5% interest per annum and cover Mahere’s legal costs.
This ruling marks a significant moment in Zimbabwean legal history, underscoring the seriousness with which the courts handle defamation cases, particularly those involving high-profile individuals.
“The courts will not tolerate defamatory statements that harm individuals’ reputations,” said Justice Mafusire. “This ruling serves as a warning to those who engage in such behavior.”
The case has garnered widespread attention, given the prominence of both parties in Zimbabwe’s legal and political spheres.
