HARARE – A Harare kombi driver has been sentenced to four months in prison after being found guilty of overloading school children and operating without mandatory certification, the Mbare Magistrates’ Court heard on Monday.
Kumbulani Tauzeni, 42, was arrested while transporting 35 pupils and three teachers along Amalinda Road, en route to Kudakwe Primary School in Glen Norah B. The vehicle, which was operating as an unroadworthy public service vehicle, was conducting the school run from Fidelity to the Glen Norah school when law enforcement intervened.
Multiple Charges, Harsh Penalties
Tauzeni faced a raft of charges, including operating without a valid defensive driving certificate and driving without a valid medical certificate issued by the General Medical Office (GMO). His primary offence, however, was carrying passengers well beyond the vehicle’s legal capacity.
Magistrate Mr. Tendai Madondo delivered the ruling, finding Tauzeni guilty on all counts. The court imposed separate fines for each transgression, with imprisonment in default of payment.
For failing to possess the required defensive driving and medical certificates, Tauzeni was fined US$100 for each offence, facing an additional 30 days imprisonment for each unpaid fine.
On the charge of carrying excess passengers—which included the 35 pupils and three teachers—he was fined US$200, with a further 60 days imprisonment should he fail to pay.
In total, Tauzeni faces four months behind bars if he does not settle the cumulative fine of US$400.
Court’s Warning to Reckless Drivers
In passing sentence, Magistrate Madondo emphasized the grave danger posed by overloading, particularly where school children are involved.
“Drivers who prioritize profit over the safety of children will face the full wrath of the law,” the magistrate reportedly told the court.
“The streets have become too dangerous for such reckless disregard for human life.”
Community Reaction
The sentence has sparked mixed reactions in the high-density suburb. Some residents applauded the court’s firm stance, while others expressed concern over the financial impact on the driver’s family.
Local transport operators, however, have been put on notice. The kombi involved in the incident was described in court documents as unroadworthy, raising further questions about the state of public service vehicles operating school routes in Harare’s southern suburbs.
The case serves as a stern warning to kombi operators flouting safety regulations, as authorities intensify efforts to curb reckless driving and overloading on roads frequented by school children.
