HARARE – Prominent journalist and activist Hopewell Chin’ono has sparked a crucial national conversation on consent and sexual rights within relationships, stating clearly that sex without consent—even within marriage—constitutes rape.
In a detailed social media post directed primarily at young men, Chin’ono outlined specific scenarios that qualify as rape under Zimbabwean law, challenging deep-seated cultural norms.
“If your girlfriend or your wife says she does not want to have sex and you proceed to have sex with her, that is rape,” Chin’ono stated unequivocally.
He expanded the definition to include acts of sexual deception and coercion, emphasizing that consent must be clear and continuous.
“If your girlfriend or wife says she wants you to have sex with a condom and you deceive her and end up having sex without a condom and she discovers it, that is rape,” he explained.
Further solidifying the principle of ongoing consent, Chin’ono added,
“If your girlfriend or wife agrees to have sex with you and then changes her mind, and she says stop and you do not stop, in law that is rape.”
His statements underscore a fundamental legal and ethical principle:
“Consent must be freely given, informed, and ongoing, and it can be withdrawn at any time.”
The post has ignited widespread discussion online, with many applauding the clear, educational messaging in a society where marital rape is often shrouded in silence or misconception.
The intervention is seen as a significant effort to promote healthier, more respectful relationships and a clearer understanding of sexual offense laws in Zimbabwe.
